TERMS OF SERVICE

Effective Date: 1 December 2025

 

Welcome to Gigevate. These Terms of Service govern your use of the Gigevate platform and services. By accessing or using Gigevate, you agree to be bound by these Terms. If you do not agree, you must not use our services.

 


1. ACCEPTANCE OF TERMS

By registering for and using the Gigevate platform, you agree to comply with and be bound by these Terms. These Terms form a binding agreement between you and Gigevate B.V. If you are using the platform on behalf of an organisation, company or legal entity, then you agree to these Terms on behalf of that organisation, company or legal entity and you warrant that you are authorised to represent it.

 


2. DEFINITIONS

Artist: A user who promotes or provides artistic performance services on Gigevate.
Content: Any text, images, audio, video or other materials uploaded or shared by users.
Event Organiser: A user who creates and manages events and books artists on Gigevate.
Public User: A user who browses or engages with public facing features but does not make bookings.
Gigevate platform: The platform including all associated services, websites and applications.
Intellectual Property: All intellectual property rights, software, content and trademarks.
User: Any person or entity using the Gigevate platform.
Trustap: Independent third party escrow provider integrated with Gigevate for secure payments.
Booking: A confirmed agreement between an Artist and an Event Organiser made through Gigevate.

 

3. USER REGISTRATION AND ACCOUNTS

3.1 Eligibility
You must be at least 18 years old and legally able to enter into agreements.

3.2 Account Creation
To access certain features, you must create an account with accurate and complete information.

3.3 Account Security
You are responsible for all activity under your account. You must notify Gigevate of any unauthorised access.

 

4. USER RIGHTS AND RESPONSIBILITIES

4.1 Licence to Use
Gigevate grants you a limited, non transferable, revocable licence to access and use the platform.

4.2 Content Ownership
You retain ownership of your content. By posting, you grant Gigevate a worldwide, royalty free licence to display and distribute your content in connection with the platform.

4.3 Booking Limitations for Public Users
Public Users cannot make bookings or use payment tools. These features are restricted to verified Artists and Event Organisers.

 

5. ACCEPTABLE USE POLICY

5.1 Prohibited Activities
Users may not:

  • Post unlawful, harmful, defamatory or infringing content

  • Harass or threaten others

  • Impersonate others or misrepresent affiliation

  • Use the platform for fraud or illegal activities

  • Disrupt platform functionality or security

  • Attempt to bypass booking and payment systems by moving transactions off platform

5.2 Monitoring and Enforcement
Gigevate may remove content or suspend accounts that violate these Terms or applicable laws.

 

6. ACCOUNT TERMINATION

6.1 Termination by User
You may delete your account at any time.

6.2 Termination by Gigevate
Gigevate may suspend or terminate accounts that violate these Terms, pose safety risks or engage in fraud.

6.3 Effects of Termination
Access to your account and data stops upon termination. Gigevate may retain information where required by law.

 

7. INTELLECTUAL PROPERTY RIGHTS

All software, branding, design and content on the platform are owned by or licensed to Gigevate. You may not reproduce or modify any part of the platform without written permission.

You retain rights to your uploaded content. You grant Gigevate a limited licence to use your content for platform functionality.

 

8. PAYMENTS, ESCROW AND TRUSTAP INTEGRATION

8.1 Use of Trustap
All financial transactions are processed exclusively through Trustap escrow. Funds are held securely until booking conditions are met.

8.2 Gigevate’s Role
Gigevate is not a payment processor and does not hold funds. Trustap manages deposits, payouts, refunds and chargebacks.

8.3 Booking Workflow

  1. Organiser submits booking request

  2. Artist accepts

  3. Organiser pays full artist fee into Trustap escrow

  4. After completion, Trustap releases payout to the Artist

8.4 Dispute Resolution
All booking disputes are handled by Trustap. Gigevate may provide supporting evidence but does not decide financial outcomes.

 

9. CANCELLATIONS AND REFUNDS

9.1 Artist Cancellation
If an Artist cancels a confirmed booking:

  • Gigevate keeps the platform booking fee

  • Trustap manages organiser refund eligibility

9.2 Organiser Cancellation
Organiser cancellations are handled case by case under Trustap’s dispute mechanism. Trustap determines whether the Artist receives full or partial payment.

9.3 Force Majeure
Trustap reviews all relevant evidence and timelines in force majeure situations.

 

10. GIGEVATE ARTIST BOOKING FEE

Artists pay a platform booking fee which is deducted from their Trustap payout.

  • Secure escrow payments

  • Booking workflow tools

  • Discovery and visibility features

  • Access to verified organisers

  • Support and safety features

 

11. ARTIST AND ORGANISER RESPONSIBILITIES

11.1 Event Organisers
Organisers agree to:

  • Provide accurate event information

  • Pay full booking fees on time

  • Ensure professional conditions at events

  • Honour confirmed bookings

  • Avoid soliciting off platform payments

11.2 Artists
Artists agree to:

  • Provide accurate service details

  • Arrive on time and perform professionally

  • Maintain communication

  • Avoid off platform negotiations

 

12. DISCLAIMERS AND LIMITATION OF LIABILITY

12.1 Disclaimer of Warranties
The platform is provided as is and as available without warranties of any kind.

12.2 Limitation of Liability
Gigevate is not liable for:

  • User behaviour or event outcomes

  • Losses arising from disputes handled by Trustap

  • Indirect, incidental or consequential damages

Consumer protections under EU law remain in place.

 

13. INDEMNIFICATION

You agree to indemnify and hold harmless Gigevate B.V., its employees and partners from claims arising from your platform use or violation of these Terms.

 

14. MODIFICATIONS TO TERMS

Gigevate may update these Terms. Continued use of the platform after updates constitutes acceptance.

 

15. GOVERNING LAW AND DISPUTE RESOLUTION

15.1 Governing Law
These Terms are governed by the laws of the Netherlands.

To comply with international consumer law:

  • EU users may resolve disputes in their country of residence

  • UK users may rely on UK consumer law

  • South African users may rely on POPIA and local protections

15.2 Dispute Resolution
Disputes should first be raised with Gigevate support.
Booking related disputes follow Trustap’s dispute resolution procedures.

 

16. MISCELLANEOUS

16.1 Entire Agreement
These Terms replace all previous agreements relating to the platform.

16.2 Severability
If any section is found unenforceable, the remainder remains valid.

16.3 Waiver
Failure to enforce any provision is not a waiver of rights.
