Booking terms and conditions

These Booking Terms and Conditions govern all bookings facilitated through the Gigevate platform between Artists and Organisers. These Terms form a legally binding agreement once a Digital Agreement has been signed and payment has been deposited into Trustap escrow. These Terms comply with applicable laws in the European Union, the United Kingdom and South Africa.
These Terms apply in addition to the Gigevate Terms of Service, Privacy Policy, Community Guidelines, and any booking specific conditions agreed between the parties.
Gigevate B.V. provides a digital platform that enables discovery, negotiation and secure booking of Artists by Organisers. All payments are protected by escrow through Trustap. Gigevate facilitates the relationship between Artists and Organisers but is not a contracting party to individual bookings.
Artists and Organisers enter into a separate Digital Agreement which becomes binding once both parties sign and the Organiser deposits payment into escrow.
Platform means Gigevate, a technology service that facilitates bookings between Artists and Organisers.
Artist means a verified user offering performance or artistic services for events.
Organiser means a verified user booking Artists for events.
User means any registered person using the Gigevate platform.
Booking means a confirmed event engagement between an Artist and Organiser.
Trustap means the third party escrow provider used by Gigevate.
Escrow means the process by which Trustap securely holds funds until booking conditions are met.
3.1 Booking Flow
Artists and Organisers negotiate terms within the platform
Both parties must digitally sign the Booking Agreement
A booking becomes active only once payment is deposited into Trustap escrow
If payment is not made within the required timeframe, the booking does not activate.
3.2 Digital Agreement
The Digital Agreement includes performance details, timings, venue information, fees, riders, cancellation terms and dispute procedures. It is binding upon both parties once signed. Each party should retain a copy for record keeping.
4.1 Escrow via Trustap
All payments must be processed through Trustap. Trustap holds the funds securely until the event has taken place and both parties confirm delivery. Payment is then released to the Artist.
4.2 Payment Deadlines
Payment must be deposited within 30 calendar days of signing
If the event is less than 30 days away, payment must be made immediately
Late payment may result in automatic booking cancellation and account penalties
These rules ensure fairness and reliability for Artists who rely on secure and timely commitments.
4.3 Fee Structure
Gigevate booking fee paid by the Organiser and displayed on the invoice
Trustap escrow fee typically 3.5 percent paid by the Organiser
Artist payout fee is deducted by Trustap based on payout method and is disclosed within the booking flow
5.1 Cancellation by the Organiser
More than 14 days before the event: Full refund minus booking fee
Less than 4 days before the event: Refund amount depends on impact to the Artist and event proximity
Trustap assesses the evidence and issues a ruling.
5.2 Cancellation by the Artist
More than 14 days before the event: Full refund to Organiser minus fees
Less than 14 days before the event: Organiser may submit a complaint within 3 days after the event date
Repeated last minute cancellations by Artists may result in account restrictions.
5.3 Force Majeure
In the case of natural disasters, government orders, emergencies or other events outside the parties’ control, either party may cancel without penalty. Refunds minus applicable platform and escrow fees will be issued.
6.1 Artist Responsibilities
Artists agree to
Arrive on time and perform the full agreed set
Deliver the performance agreed in the Digital Agreement
Honour technical and hospitality riders
Communicate promptly in the event of delays or issues
6.2 Organiser Responsibilities
Organisers agree to
Provide safe access to the venue and required technical setup
Ensure reliable contact persons and event day logistics
Honour hospitality commitments
Maintain a safe and respectful working environment
Failure to provide essential technical or venue access may affect dispute rulings.
7.1 Raising a Complaint
Complaints must be filed within 3 calendar days after the event. The booking will change to “Under Review”. Evidence may include chat logs, timestamps, photos, audio, video or witness statements.
7.2 Resolution Steps
Parties should first attempt resolution via platform chat
If unresolved, Trustap reviews the dispute
Trustap decisions typically take 5 to 10 business days
7.3 Trustap Ruling
Trustap reviews the Digital Agreement, platform records and submitted evidence. A ruling may include
Full refund
Partial refund
No refund
Trustap decisions are final and binding. Gigevate cannot overturn these decisions.
7.4 Unsupported Complaints
Complaints must relate to breach of contract. The following are not valid reasons
Disliking music style if the agreed genre was delivered
Low audience turnout
Minor delays not affecting overall performance
Equipment issues not caused by the Artist
Payment is released to the Artist within 1 to 3 business days if no complaint is submitted. Refunds are processed by Trustap. Processing time depends on payment method and financial institution. Incorrect payout details provided by users may result in delays.
9.1 Exclusive Use
Bookings initiated on Gigevate must be completed through the platform.
9.2 Off Platform Dealings Prohibited
Attempts to move the booking or payment off platform including arranging private payments or bypassing escrow violate these Terms.
9.3 Enforcement Policy
First breach: Written warning
Second breach: Account suspension
Third breach: Permanent removal from the platform
This protects artists, organisers and overall platform trust.
10.1 Cooling Off Rights
In line with EU, UK and South African consumer law
Users may cancel within 14 days of agreement
This right does not apply once the service has begun or the performance has taken place
10.2 Governing Law
South African users: Law of the Republic of South Africa
UK users: Law of England and Wales
EU users: Law of your country of residence
Mandatory local consumer protections apply.
Trustap processes payment information securely
Gigevate does not store card or banking information
All processing is subject to the Gigevate Privacy Policy
Users consent to Trustap handling booking, payment and dispute data
Gigevate may amend these Terms. Changes will apply

After 30 days for existing bookings
By signing the Digital Agreement or accepting a booking you confirm that you
Have read and understood these Terms
Acknowledge Trustap’s role as escrow and dispute resolver
Agree to the cancellation refund and dispute rules
