ARTIST SERVICE AGREEMENT
Effective Date: 1 December 2025
This Artist Service Agreement governs the use of the Gigevate platform by Artists. By registering as an Artist on Gigevate or by completing your profile or by accepting or responding to booking requests you agree to be bound by this Agreement. This Agreement forms part of the Gigevate Terms of Service and works alongside the Booking Terms and Conditions the Privacy Policy the Community Guidelines and any Digital Agreements signed within the platform.
1. INTRODUCTION
Gigevate B.V. provides a digital platform that enables Artists to showcase their work receive booking requests communicate with Organisers and secure payments through Trustap escrow. Gigevate is not a party to performance contracts between Artists and Organisers. Gigevate facilitates communication payments and dispute procedures but does not guarantee bookings or outcomes.
This Agreement outlines the rights obligations and responsibilities of Artists using the platform.
2. DEFINITIONS
Artist means a verified user offering performance or artistic services for booking through Gigevate.
Organiser means a verified user booking an Artist for an event.
Platform means the Gigevate website and application including booking tools communication channels and account dashboard.
Digital Agreement means the binding booking contract signed by the Artist and Organiser.
Trustap means the third party escrow provider used for secure payments.
User means any individual using the platform.
3. ARTIST ELIGIBILITY
Artists must

Be at least 18 years old

Provide accurate personal and professional information

Maintain an active profile and comply with all platform rules

Be legally capable of entering into binding agreements
Gigevate may require identity verification and may suspend or remove accounts that fail verification or breach platform rules.
4. ARTIST RESPONSIBILITIES
Artists agree to

Honour all confirmed bookings
-
Deliver performances as described in the Digital Agreement

Communicate professionally and promptly with Organisers
-
Arrive on time and perform the full agreed duration
-
Respect venue rules staff and event attendees
-
Maintain safe and professional conduct
Failure to fulfil responsibilities may lead to negative dispute outcomes account penalties or removal.
5. PROFILE ACCURACY
Artists must ensure that all profile information is accurate complete and regularly updated including

Stage name and legal name
-
Music genre
-
Images videos and promotional material
-
Bio and professional history
-
Technical rider and requirements
-
Contact preferences
Misleading or false information may result in booking cancellations penalties or account suspension.
Artists grant Gigevate a non exclusive royalty free licence to display and promote their profile and content on the platform and in related marketing.
6. BOOKING EXPECTATIONS
Artists agree that

All booking negotiations must occur within the platform

All bookings must be completed through the Digital Agreement
-
No performance occurs until payment is deposited into Trustap escrow
-
Artists must review and confirm all booking details before signing
Artists should not commit to external bookings that conflict with accepted Gigevate bookings.
If an Artist is unable to attend an event they must notify the Organiser immediately through the platform.
7. BEHAVIOUR STANDARDS
Artists must comply with Gigevate Community Guidelines and must not

Engage in harassment discrimination or abusive conduct

Arrive intoxicated or unable to perform

Endanger staff attendees or organisers
-
Engage in unprofessional behaviour that harms the event or reputation of the platform
Gigevate may investigate conduct concerns and take action including warnings suspensions or removal.
8. RIDER REQUIREMENTS
Artists must ensure technical and hospitality riders are

Accurate
-
Realistic
-
Provided before signing the Digital Agreement
Organisers rely on riders for setup and planning. Updates to riders after signing may require mutual agreement.
9. PAYMENTS AND FEES
All Artist payments are processed exclusively through Trustap escrow.
9.1 Escrow Requirements

Payment must be deposited by the Organiser before the booking becomes active

Funds are held securely until the performance is completed
-
Payment is released only when both parties confirm delivery or after the set Trustap time window
9.2 Deductions and Fees

Trustap payout fees based on selected payout method apply to all Artist payments
-
Gigevate does not take a percentage from the Artist payout
-
Full fee transparency is shown before signing the Digital Agreement
Gigevate does not store or process bank details. Trustap handles these details securely.
10. INTELLECTUAL PROPERTY
Artists retain ownership of all music recordings images videos and promotional materials they upload.
Artists grant Gigevate a non exclusive licence to

Display their profile and content on the platform

Use promotional material for platform marketing with attribution
Artists confirm they have rights to all uploaded content and that it does not infringe third party rights.
If a copyright complaint is filed Gigevate may remove content in accordance with its Copyright Policy.
11. OFF PLATFORM RULES
Artists must not attempt to

Move bookings outside Gigevate
-
Request or accept direct payments
-
Send personal contact details for off platform negotiation
-
Encourage Organisers to bypass Trustap escrow
These actions undermine platform safety and violate this Agreement.
Three strike enforcement

Strike 1: Warning
-
Strike 2: Account suspension
-
Strike 3: Permanent removal
Severe breaches may lead to immediate removal without warning.
12. DISPUTE RULES
Disputes must be raised within 3 calendar days after the event.
Artists agree to

Provide accurate evidence when requested

Participate in resolution via platform chat
-
Accept Trustap’s final ruling which Gigevate cannot override
Trustap may issue full refunds partial refunds or release the full payout depending on the evidence and Digital Agreement.
Unsupported dispute reasons include

Artistic differences
-
Personal preferences
-
Crowd turnout
-
Venue atmosphere
Disputes must relate to breach of contract or performance failure.
13. CANCELLATION BY ARTISTS
If an Artist must cancel they agree to

Notify the Organiser immediately

Provide a valid reason within the platform
Frequent cancellations may result in

Reduced booking visibility
-
Temporary restrictions
-
Account removal for repeated misuse
Trustap may issue refunds to Organisers based on cancellation timing and Digital Agreement conditions.

15. AMENDMENTS
Gigevate may update this Agreement at any time. Changes apply

Continued use of the platform confirms acceptance.
