ORGANISER SERVICE AGREEMENT

Effective Date: 1 December 2025

 

This Organiser Service Agreement governs the use of the Gigevate platform by Organisers. By registering as an Organiser on Gigevate or by creating an event or by requesting a booking or by signing a Digital Agreement you agree to be bound by this Agreement. This Agreement forms part of the Gigevate Terms of Service the Booking Terms the Privacy Policy the Community Guidelines and the Copyright Policy.

 


1. INTRODUCTION

Gigevate B.V. provides a platform that allows Organisers to discover Artists request bookings negotiate terms sign Digital Agreements and process secure payments through Trustap escrow.
Gigevate is not a party to any performance contract between Organisers and Artists. Gigevate facilitates communication booking flows payment handling and dispute procedures but does not guarantee performance outcomes.

This Agreement sets out the rights responsibilities and obligations of Organisers using the platform.

 


2. DEFINITIONS

Organiser means a verified user booking Artists for events through Gigevate.
Artist means a verified user offering performance services for booking.
Platform means the Gigevate website and application including communication channels event tools and booking system.
Digital Agreement means the binding booking contract signed by both parties.
Trustap means the third party escrow provider used to process funds.
User means any individual using the Gigevate platform.

 


3. ORGANISER ELIGIBILITY

Organisers must

  • Be at least 18 years old

  • Provide accurate and complete information

  • Be legally capable of entering into binding agreements

  • Use the platform in a professional and lawful manner

Gigevate may require identity or business verification. Accounts may be suspended or removed if verification fails or if platform rules are breached.

 


4. ORGANISER RESPONSIBILITIES

Organisers agree to

  • Provide clear and accurate booking information

  • Honour all confirmed bookings

  • Ensure payment is deposited into Trustap escrow within required deadlines

  • Provide accurate venue details including access information

  • Maintain communication before during and after the event

  • Create safe and professional working conditions for Artists

Failure to fulfil responsibilities may lead to disputes refunds penalties or account removal.

 


5. EVENT AND VENUE REQUIREMENTS

Organisers must ensure that

  • The venue is safe for performers and attendees

  • Required technical equipment is available and operational

  • Hospitality and rider requirements are fulfilled as stated in the Digital Agreement

  • A clear contact person is available on the event day

  • Logistics are communicated clearly including parking access stage times and soundcheck details

If venue or technical conditions prevent an Artist from performing the Organiser may be held responsible in a dispute.

 


6. PROFILE ACCURACY

Organisers must maintain accurate profile and event information including

  • Organisation or event name

  • Location and dates

  • Type of event and expected audience

  • Technical capabilities

  • Contact information

Misleading information may affect dispute rulings and may result in account penalties.

 


7. BOOKING EXPECTATIONS

Organisers agree that

  • All negotiations must occur within the platform

  • A booking becomes legally binding once the Digital Agreement is signed

  • A booking only activates once payment is deposited into Trustap escrow

  • Artists have the right to decline or renegotiate terms before signing

  • Event details must not materially change after signing unless mutually agreed

Organisers must not request performances before payment is secured in escrow.

 


8. BEHAVIOUR AND SAFETY STANDARDS

Organisers must ensure

  • Professional and respectful communication

  • No harassment threats discrimination or unsafe conditions

  • Artists are treated fairly and respectfully onsite

  • Security staff and event teams cooperate with Artists

  • Emergency procedures are in place and communicated if relevant

Gigevate may investigate conduct concerns and take appropriate platform action.

 


9. RIDER OBLIGATIONS

Organisers must honour all technical and hospitality riders included in the Digital Agreement. If any rider cannot be fulfilled the Organiser must communicate this before signing.

Failure to provide essential rider items may result in

  • Adjusted performance

  • Dispute rulings in favour of the Artist

  • Refund reductions

  • Platform penalties

 

10. PAYMENTS AND FEES

10.1 Escrow Requirement
All booking payments must be made through Trustap.
Payment is required

  • Within 30 calendar days of signing the Digital Agreement or

  • Immediately if the event is less than 30 days away

10.2 Fee Responsibilities
Organisers are responsible for

  • The Gigevate booking fee

  • The Trustap escrow fee

  • Any additional payment processing costs shown in the invoice

Artists receive payment only after the event when both parties confirm completion or when Trustap releases funds by default.

 


11. INTELLECTUAL PROPERTY

Organisers may not

  • Use Artist images videos logos or music without permission

  • Use Artist content for advertising unless granted rights in writing

  • Misrepresent or falsify Artist involvement in events

Any intellectual property usage must be agreed in the Digital Agreement or with written consent.

 


12. OFF PLATFORM RULES

Organisers must not

  • Request or offer direct payment outside Gigevate

  • Move negotiation or booking off platform

  • Circumvent Trustap escrow

  • Ask Artists for personal contact details to bypass the platform

These actions undermine platform safety and violate this Agreement.

Three strike enforcement

  • Strike 1: Warning

  • Strike 2: Account suspension

  • Strike 3: Permanent removal

Severe breaches may result in immediate removal.

 


13. DISPUTE HANDLING

Disputes must be raised within 3 calendar days after the event.

Organisers must

  • Submit evidence clearly and accurately

  • Use platform chat for initial resolution

  • Accept Trustap’s final decision

Trustap may rule for

  • Full refund

  • Partial refund

  • No refund
    Depending on the Digital Agreement and submitted evidence.

Unsupported disputes include

  • Disliking the Artist’s music style if it matched the agreement

  • Lower audience turnout than expected

  • Venue atmosphere or crowd reaction

Disputes must relate to breach of contract or delivery failure.

 


14. CANCELLATION BY ORGANISERS

Organisers must follow cancellation rules in the Booking Terms.
Penalties may apply depending on timing.

Frequent cancellations may result in

  • Booking restrictions

  • Reduced visibility to Artists

  • Account removal for misuse

Force majeure cancellations follow standard platform policy.

 


15. PLATFORM RULES AND ENFORCEMENT

Organisers must comply with

  • Terms of Service

  • Booking Terms

  • Artist Service Agreement

  • Privacy Policy

  • Community Guidelines

  • Trustap Payment Terms

Gigevate may take enforcement action for violations including warnings suspensions and permanent removal.

 


16. AMENDMENTS

Gigevate may update this Agreement at any time.
Changes apply

  • Immediately for new Organisers

  • After 30 days for existing Organisers

Continued platform use confirms acceptance.
