COPYRIGHT POLICY

Gigevate B.V. (“Company”, “we”, “us” or “our”) respects the intellectual property rights of others and expects all users of the Gigevate platform (“Users”) to do the same. This Copyright Policy outlines how we handle copyright infringement claims and the responsibilities of users when uploading or sharing content.

1. PURPOSE

This policy sets out Gigevate’s procedures for addressing copyright infringement claims, including how users can report or respond to alleged infringements and what actions Gigevate may take to address violations.

2. REPORTING COPYRIGHT INFRINGEMENT

2.1 Notification Requirements

Your notice must include the following information:

  • A physical or electronic signature of the person authorised to act on behalf of the copyright owner
  • Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered
  • Identification of the allegedly infringing material and information sufficient to locate it on the platform
  • Contact information including name, address, telephone number and email address
  • A statement that you have a good faith belief that the disputed use is not authorised by the copyright owner, their agent or the law
  • A statement that the information in the Notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the copyright owner

3. COUNTER-NOTIFICATION

3.1 Counter-Notification Requirements

Your counter-notification must include:

  • A description of the content that was removed or disabled
  • A description of where the content appeared before it was removed
  • Your name, address, phone number and email address
  • A statement, under penalty of perjury, that you believe in good faith the material was removed in error
  • A statement that you consent to the jurisdiction of the courts in your country or, if outside South Africa, in Johannesburg, South Africa

Counter-notifications should be sent to the Copyright Agent listed above.

4. USER RESPONSIBILITIES

4.1 Compliance with Copyright Law

Users are responsible for ensuring that any content they upload to Gigevate does not violate the copyrights or other proprietary rights of others.

4.2 License to Use

By uploading content, you confirm that you have the legal right to share it and that you grant Gigevate and its users a non-exclusive, royalty-free, perpetual and worldwide licence to use, reproduce, distribute, adapt, publish and display the content in connection with Gigevate’s services.

5. PENALTIES FOR INFRINGEMENT

5.1 Removal of Infringing Content

Upon receipt of a valid Notice, we will promptly remove or restrict access to the content in question and may notify the user who posted it.

5.2 Termination of Accounts

Gigevate reserves the right to terminate the accounts of repeat infringers. A repeat infringer is any user who has received more than two copyright complaints or had more than two pieces of content removed.

5.3 Legal Action

Where necessary, Gigevate may pursue legal action against users who repeatedly or intentionally infringe copyrights, including seeking injunctive relief or damages.

6. MODIFICATION OF POLICY

Gigevate may modify this Copyright Policy at any time at our sole discretion. Updates will become effective immediately upon posting the revised version on the platform.
